Rule 38
<br> who can appoint a customs agent
An exporter or importer may personally attend the customs office and pass the goods inspection or perform other duties related to the customs office.
(2) If the exporter or importer is a government agency, an organization or entity wholly or partially owned by the Government of Nepal, the board of directors or the executive head or administrative head of such organization or agency decided and designated by the existing employees of the same organization or agency to attend the customs office to inspect the goods. Or can perform other tasks related to the customs office.
(3) If the exporter or importer is a firm, company, organized organization or body registered in accordance with the prevailing law, the manager or partner or executive head or administrative head or executive head of such firm, company, organized organization or body designated by the firm, company, organized body Official level employees of organizations or agencies can attend the customs office and pass goods inspection or perform other tasks related to the customs office.
(4) If an exporter or importer wants to have the goods inspected through a customs agent or to carry out work related to the customs office, he can appoint a customs agent by giving a letter of appointment to the customs agent in the format as per schedule-7.
(5) For appointing a customs agent in accordance with sub-rule (4), the exporter or importer shall submit the renewed customs agent's license along with such appointment letter, proof confirming that the person signing the agent's appointment letter is an authorized exporter or importer, certificate of registration in case of firm, company, organized organization or body. And a certified copy of the certificate of permanent account number must also be provided to the head of the customs office where the goods are exported or imported through the customs agent appointed by him. If it is necessary to check the authenticity of such certificates, the head of the customs office can request a complete certificate. But,
(a) Any ExporterOr if the importer re-appoints the same customs agent in the same customs office, the documents mentioned in this rule do not need to be renewed.
(b) If the exporter or importer is a natural person, he shall provide a certified copy of the certificate along with the customs agent appointment letter along with the renewed customs agent's license, certificate of citizenship and certificate of permanent account number.
(6) The appointment letter as per sub-rule (5) and the documents attached to it shall be submitted by the relevant customs agent to the head of the customs office where the goods of the exporter or importer are appointed.
(7) Upon examination of the appointment letter of the customs agent submitted as per sub-rule (6) and the documents attached to it, if it appears that the customs agent appointed by the exporter or importer will be allowed to perform customs-related work, the head of the customs office shall make the customs agent fill in the necessary details in the appointment letter and sign such The appointment letter should be recorded and verified.
(8) If, upon examination of the appointment letter of the customs agent submitted as per sub-rule (6) and the documents attached to it, it appears that the customs agent appointed by the exporter or importer is not allowed to perform customs-related work, the head of the customs office shall cancel such appointment letter and inform the concerned exporter in writing through the same customs agent. or should be given to the importer.
(9) The customs agent appointed before the commencement of this regulation shall complete the procedure as per sub-rules (5), (6) and (7) within thirty days from the date of commencement of this regulation. If he does not complete such procedure, he will not be allowed to work as a customs agent.
